By engaging MDC IT Solutions ("we", "us", "our") for services, or by using this website, you agree to the terms outlined below. If you do not agree, please do not use our services or this site.
2. Services
We provide web development, software development, automation, data science, cloud, and related digital services as agreed in a project proposal, quote, or statement of work. Exact scope, deliverables, and timelines are confirmed with each client before work begins.
3. Quotes & Proposals
Quotes are estimates based on the information provided at the time and may be revised if project scope changes. A quote does not constitute a binding contract until accepted in writing by both parties.
4. Payment Terms
Payment schedules are agreed on a per-project basis, typically involving a deposit before work begins and milestone or completion payments thereafter. Late payments may result in paused work until accounts are settled.
5. Client Responsibilities
Clients are responsible for providing timely feedback, necessary access, content, and information required to complete the project. Delays caused by incomplete information may affect delivery timelines.
6. Intellectual Property
Unless otherwise agreed in writing, ownership of final deliverables transfers to the client upon full payment. We retain the right to showcase completed work in our portfolio unless the client requests otherwise.
7. Confidentiality
We treat all client information and project details as confidential and will not disclose them to third parties without consent, except where required by law.
8. Limitation of Liability
We aim to deliver reliable, well-tested work, but we are not liable for indirect, incidental, or consequential damages arising from the use of delivered systems, to the extent permitted by law.
9. Termination
Either party may terminate an engagement with written notice. The client remains responsible for payment of work completed up to the termination date.
10. Governing Law
These terms are governed by the laws of Australia, without regard to conflict of law principles.
11. Changes to These Terms
We may update these terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the updated terms.
